As of January 1, 2014, Illinois Public Act 98-129 allows Illinois elementary and secondary schools to request or require that students provide access to their social media passwords.
The new law specifically provides that the school can request the student’s social media password information in the case that they believe the student’s account on a social media networking site has evidence that the student has violated a school rule or policy.In order to meet the requirements of the statute and obtain a student’s social media password, the school must provide advance notice to the student and his or her parents by publishing the notification of the school’s intent to obtain passwords in these situations in the school’s rules, policies, or handbook. The statute also provides certain limitations to post-secondary institutions obtaining student social media passwords.
